What is the ruling on trading, smuggling, and selling antiquities, and is it permissible for a person to own antiquities found beneath his house?

There is no objection for a Muslim to search for the wealth of disbelievers from before Islam, whether in land he owns or in land not owned by anyone. Whoever finds something from it must pay one-fifth of it and spend it on the categories of Zakat, and the remaining portion is his to dispose of as he wishes. The basis for this is the hadith, "And in rikaz is the fifth," which implies permission for it. However, one should weigh the risks and harms resulting from violating the law against the benefits of extracting these funds.
