The sayings of the jurists have varied regarding blood discharged due to miscarriage and when it is considered nifas (postpartum bleeding). The majority of jurists hold that if some of the embryo's creation is discernible, such as a head or a finger, then the blood is nifas.
However, if nothing of the embryo's creation is discernible, they have differed: Malikis and Shafi'is: If the woman discharges an 'alaqah (clot) or a mudghah (lump of flesh), and experts in such matters state that it is the beginning of human creation, then the blood is nifas. Hanafis and Hanbalis (and this is the view given fatwa): There is no nifas for her unless human creation becomes apparent, which does not occur before eighty-one days have passed.
Therefore, if the gestational age is sixty-seven days, the discharged blood is istihada (irregular bleeding) and not nifas. It is not considered menstruation unless it coincides with the usual time of her menstrual period.
