Is the marriage considered void if it took place after adultery, without the repentance of either party, and without the knowledge of the girl's father? And how can it be annulled if the husband refuses to divorce? And is the girl obligated to seek Khulʿ? And is it permissible for her to marry another before the annulment of the contract? And which authority is empowered to annul this contract?

The guardian's contracting of the marriage under the aforementioned circumstances does not fall under the duress considered unlawful by Islamic law, which involves threats of killing or severe harm. The marriage is valid as long as scholars have differed on the condition of repentance for the validity of the marriage between two fornicators, and the opinion that validates it entails her remaining his wife. Therefore, it is not permissible for the woman to marry anyone other than this man unless he divorces her or their marriage is annulled. If he refuses to divorce her, the judge shall annul his marriage. Both of them must repent and conceal the sin.
