Is ta'zeer obligatory, desirable, or permissible? And is it for every sin, or is it limited to sins whose harm extends to others? And does it cease with repentance? And is it the first or the last solution? And does one who rejoices at the lack of ta'zeer for sinners in his country commit kufr? And what is the way to get rid of this feeling?

Ta'zir (discretionary punishment) is prescribed for every sin for which there is no prescribed hadd (fixed punishment) or kaffarah (expiation). It is the prerogative of the ruler or his deputy, with the exception of the husband in disciplining his defiant wife, and the guardian or teacher of a minor. Scholars differ regarding its ruling, oscillating between obligation and recommendation. Ta'zir is waived by repentance. The most effective approach is mutual advising with the sinner, reminding them of the Hereafter, and strengthening their faith. Rejoicing over the absence of ta'zir for sinners may be impermissible if its reason is the disabling of Allah's law.
