It is permissible for a woman to appoint one of her brothers as a general proxy, and this includes the guardianship of marriage, according to the preponderant opinion of the Maliki school. Therefore, none of the brothers has the right to object to whom the woman appoints as her proxy. Some scholars are of the opinion that the eldest and most virtuous brother should be given precedence in the guardianship of marriage, acting upon the hadith (definition) "Let the elder lead." If they dispute and do not prioritize the elder, then lots should be drawn between them. What the eldest brother does by rejecting suitors without justification is considered a forbidden act of 'adl (unjust withholding), and the guardian's poor reception of suitors is considered one of the forms of 'adl.
