Is it permissible for a person afflicted by sorcery to kill the sorcerer who insists on harming him and renewing the magic against him, in light of the non-application of hudud punishments and the law's non-recognition of sorcery? And if it is not permissible, then how can the afflicted person ward off the sorcerer's harm from himself?

The victim of magic is not permitted to kill the magician, for several reasons:

1. The difficulty of verifying magic or the enquirer's affliction by it, as both are hidden matters. 2. The victim of magic is still alive. 3. The implementation of legal penalties (hudud) and retribution (qisas) is the prerogative of the ruler or his deputy, and individuals do not have the right to do so, to prevent chaos. It has been reported that the Companions (Sahabah) denounced the implementation of legal penalties without the ruler's authority.

The majority of scholars are of the opinion that a magician is to be killed as a legal penalty for apostasy, or as retribution if he kills an inviolable soul with his magic. However, the proving of magic and the execution of the punishment are handled by the ruler responsible for the affairs of Muslims.

The victim of magic is advised to consistently recite prescribed remembrances (adhkar) and legal protective supplications (tahsinat shar'iyyah) for protection from the evil of magicians and others.
