The wine drinker who dies while persistent in his sin or in a state of drunkenness is to be washed, shrouded, and prayed over; because he died as a sinner, not as a disbeliever. This is what the scholars have agreed upon. As for the one who abandons prayer, praying over him is based on the differing opinions regarding his status. Whoever deems him a disbeliever does not pray over him, and whoever considers him a sinful Muslim prays over him. The opinion of praying over him is more preferable, as it is the view of the majority.
