Is the husband obligated to demand the return of his wife, who left him after ten days of marriage under the pretext of illness, and whose family then refused to return her, or to demand compensation for the material losses the husband incurred?

The jurists stipulated that insanity is one of the defects that invalidate marriage, because it defeats its purpose. However, this defect is not considered grounds for annulment if the husband was aware of it and consented to it. If the annulment occurs after consummation, the wife is entitled to the full mahr (dowry), and the guardian guarantees the dower. The husband has the option to annul the marriage and demand the dower from the guardian if his wife reaches a state of losing her mind, or to seek khul' (divorce initiated by the wife in exchange for compensation) if she recovers and does not wish to return.
