What is the ruling on selling a minor, whether discerning or not discerning?
The sale by an indiscriminating child is void. As for the discriminating child, their sale is valid with the permission of their guardian, or if their transaction is ratified, according to the Hanbalis, Malikis, and Hanafis, contrary to the Shafi'is and one narration among the Hanbalis. Those who affirm the validity of their sale with the guardian's permission cite the Almighty's saying: "And test the orphans until they reach the age of marriage. If you perceive in them sound judgment, then hand over their property to them."
