What is a "Misyar" marriage, and is it permissible or forbidden?

Misyar marriage is a legitimate contract between a man and a woman, fulfilling all its pillars and conditions, in which the woman waives some of her rights, such as financial support (nafaqa), housing, or overnight stays. This type of marriage emerged due to various social and economic reasons.

Scholarly opinions regarding its ruling have differed. Some scholars have permitted it, provided that it meets the legitimate pillars and conditions, is announced, and not concealed. Others have deemed it disliked or prohibited due to potential harms that may arise, such as the humiliation of the woman or the neglect of children, especially if it is misused. Among the prominent scholars who permitted it are Sheikh Ibn Baz and Sheikh Abdul Aziz Al Sheikh. However, Sheikh Ibn Uthaymeen later stopped permitting it, and Sheikh Al-Albani prohibited it.

It is held that if Misyar marriage fulfills the legitimate conditions, it is a valid contract. It may be suitable for the specific circumstances of some men and women, but the circumstances of each case should be considered individually to prevent its misuse or the occurrence of harms.
