What is a "Misyar" marriage?
There are two forms of Misyar marriage: The first is that the contract is concluded, fulfilling all pillars and conditions, with the husband waiving the right to maintenance and housing. The second is that the husband does not stipulate the waiving of maintenance, but rather non-compliance with the division of nights for lodging. This marriage contract is valid as long as it fulfills the conditions and pillars. It is not affected by one of the spouses voluntarily waiving some of their rights. Statements have been reported from some of the Salaf permitting conditions in marriage. This type of marriage has benefits, such as preserving chastity, but it is not free from issues regarding rights and inheritance after the husband's death. The preponderant opinion is that it is permissible, due to the absence of evidence for its prohibition after fulfilling the conditions of a valid marriage. It is not a temporary Muta'ah marriage.
