The wife's right is in the land only if she does not participate with her husband in the building. The husband is not allowed to build on the land without his wife's permission, because she is a partner with him in it. A partner is not allowed to dispose of joint property without the permission of their co-partner. If he does so, he is obligated to demolish it due to his transgression. However, if the wife gives her husband permission to build on the jointly owned land, there is no objection to him doing so, and the building becomes exclusively his, while the land remains jointly owned between them.
