What you have mentioned about your husband indicates that you are unlawful to him and irrevocably separated from him, due to his swearing by divorce and repeating it three times, and his subsequent statement, "You are divorced by three," in addition to his frequent conditioning of divorce, and your fulfilling the conditions upon which he made your divorce contingent. However, it is necessary to refer the matter to the Sharia courts or their equivalent, such such as Islamic institutions and bodies, for them to review the case, inquire from the husband, and hear his claim.

Furthermore, the husband's abandonment of prayer and fasting is a serious matter. Some scholars are of the opinion that abandoning prayer is disbelief that expels one from the faith. There is no good in remaining with someone who abandons prayer and fasting. If your unlawfulness to him is not established, you may request separation from him due to his abandonment of prayer and fasting, or seek khul' (divorce by mutual consent) if that is not feasible, by returning the dowry and similar considerations to him, in order to free yourself from him and escape his harm.
