Is it permissible to separate a husband and wife if the husband does not pray, smokes, and is semi-illiterate?

Instead of advising the woman to separate from her husband, he should be advised to repent and abstain from grave sins, and the danger of abandoning prayer should be explained to him. If he does not repent, many jurists have permitted the wife to seek annulment due to a defect in the husband's religiosity. This view was favored by Sheikh Ibn 'Uthaymeen, who based his argument on the hadith of the wife of Thabit ibn Qais. Therefore, there is no harm in advising her to seek annulment Islamically.
