Is it permissible to distribute the wealth of a sister afflicted with Alzheimer's and placed under guardianship, who has no children, among her needy siblings, knowing that she used to help them previously?
It is not permissible to take anything from the money of the aforementioned woman and divide it among her siblings or others. Her being interdicted due to old age or Alzheimer's disease does not justify disposing of her money through a gift. Her guardian is obligated to pay the on her money and spend on her only from it. It is not permissible for him to gift anything from it because a guardian is not allowed to dispose of the interdicted person's money except for what is in their interest. What does not benefit the interdicted person, such as a gift without compensation, is not within the guardian's authority, and he is liable to guarantee what he has gratuitously given away.
