Is it correct to say that the sheikh is killed in retribution (qisas) if he kills a young man, but the young man is not killed in retribution (qisas) if he kills a sheikh?
If an old man kills a young man, or vice versa, retribution (qisas) is applied to both, due to the generality of Allah's saying: (And We ordained for them therein a life for a life) and His saying: (O you who have believed, prescribed for you is legal retribution for those murdered — the free for the free). However, if the killer is a child who has not reached puberty, retribution is not applied to him, due to the Prophet's (peace be upon him) saying: (The pen has been lifted from three: from the child until he reaches puberty...), and because qisas is a severe punishment that is not obligatory upon a child or one who has lost their mind, due to their lack of sound intention.
