Is the money taken by the broker from the buyer, in the context of selling land at a lower price to one of the seller's relatives after the broker had brought another buyer at a higher price, unlawful (haram)?
The issue consists of two parts:
First: The ruling on the buyer paying money to the broker without the latter coming from the buyer's side. This is permissible as long as it is by mutual consent, based on the Prophet's (peace be upon him) saying: "The property of a Muslim person is not lawful except with his willing consent." And it is permissible for the seller to sell his land for less than its market value.
Second: This pertains to the validity of the wife's disposal of the inherited property and her selling it while there are other heirs. This has been clarified in Fatwa no. 49861.
