Is describing a person as "having a concubine" or "having a paramour" considered slander (qadhf)?

This wording is not explicit in accusing someone of fornication (qadhf); rather, it is an allusion (kinayah), and there is disagreement among scholars regarding it. The preponderant view is that it depends on the speaker's intention. If he intended to accuse someone of fornication, then the prescribed punishment (hadd) is due. If he did not intend it, then his word is accepted with his oath, and there is no hadd on him. However, the ruler may discipline and punish him discretionarily.
