The custody (hadhanah) of young children, both male and female, belongs to the mother unless there is a legitimate impediment. Scholars have differed regarding the validity of a mother waiving her right to custody: whether it is a right belonging to her, which she can forfeit by relinquishing it, or a right belonging to the child being cared for. If the mother waives custody, the right then transfers to the next eligible person.
