Is it permissible for a husband to take back his wife after the third divorce, and is the fatwa of Sheikh Ahmad Zarruq al-Maghribi al-Maliki, which permits this in cases of necessity (nawazil) under the following three conditions, sound: "1- The prevalence of corruption in the land, 2- Fear of neglecting her children, and 3- The husband's poverty and the fear of him committing zina (fornication/adultery)"?

When a man divorces his wife with three pronouncements of divorce, she becomes irrevocably separated from him (Baynunah Kubra), and she is not lawful for him until she marries another husband. This is explicitly stated in the Holy Quran and is a consensus among scholars. It is not permissible for a man who has divorced his wife three times to marry her again until she marries another husband, a marriage of true desire, and then he divorces her or dies, and her waiting period (iddah) ends. This is the established legal ruling that must not be violated. What has been attributed to Zarrouq in contradiction to this does not seem correct, as it goes against the fundamentals of his school of thought.
