If the missing person returns after the judge has ruled him deceased and finds that his wife has remarried, he is given a choice between two options: either his wife returns to him, or she remains with her second husband, and the missing person takes the dower (sadaq) that he had paid her from her second husband. If he chooses his wife, the second husband is not entitled to any of the dower he paid, due to his conjugal relations with her, and because he married her knowing she was the wife of a missing person.
