What is the ruling on a marriage contract that was concluded in the bride's home country in the presence of her mother only, with the bride herself absent due to administrative reasons? Is it a condition to have a new marriage contract in her country of residence in Europe in the presence of a Muslim guardian there, given that her father and grandfathers are deceased, and her paternal uncles do not sponsor her, and one of them blessed this marriage?

If a man marries a woman without a wali (guardian), then his marriage is invalid according to the majority of scholars, due to the hadith: "There is no nikah (marriage) without a wali." The wali of a woman in marriage is her father, then her grandfather, then her son, then her full brother, then her half-brother (from the father's side), then their sons, then the paternal uncles. So, as long as the woman has a Muslim, sane paternal uncle, he is the one who should marry her off. It is permissible to delegate the conducting of the legal marriage contract over the phone.
