Is it obligatory for someone who committed zina (fornication/adultery) and repented, and subsequently contracted a disease as a result, to inform the girl he wishes to marry about his illness and his past, especially if one of them is the very person with whom he committed zina and transmitted the disease (herpes) to her, and she too has repented?

If the two fornicators repent, it is permissible for them to marry. A person afflicted with herpes must inform anyone he proposes to about his contagious disease. If she accepts, then all is well; otherwise, he should be patient until he is cured or finds someone who accepts him. If he is cured, he is not obligated to inform her.

If both parties are afflicted, the Hanbalis stated that the sounder opinion is the establishment of the option to annul the marriage due to the presence of its cause, and that disclosure is obligatory.

Whoever is afflicted with fornication must repent and conceal his sin, and not inform anyone of his transgression.
