Is the husband's statement to his wife's brother, "I intend to divorce your sister," considered a pronouncement of divorce? And is the husband's statement to his wife, "I intended to say, 'You are divorced, so-and-so,' " considered a pronouncement of divorce?

A mere intention to divorce or communicating this intention does not constitute a divorce, based on the statement of the Messenger of Allah, peace and blessings be upon him: "Indeed, Allah, the Exalted and Glorious, has pardoned for my Ummah (nation) what they whisper to themselves, as long as they do not act upon it or speak of it." However, a husband's statement to his wife, "You are divorced," is considered an explicit divorce and thus effects the divorce, even if he did not intend it. It is advisable to reconcile if this is not the third divorce, in order to avoid the negative consequences of divorce, especially when children are involved. Care should be taken to foster understanding and resolve marital issues without resorting to divorce whenever possible.
