If a father prevents his daughter from marrying a suitable man (kuf’), he is considered to be unlawfully withholding her (ʽāḍil). However, she is not permitted to marry without a guardian (walī). If the father insists on his refusal, she may present her case to the judge (al-Qāḍī al-Sharʽī) for him to marry her or to order her guardian to do so.
