Swearing by divorce is impermissible. The majority of scholars hold that divorce takes effect if the sworn-upon condition occurs, contrary to the view of Ibn Taymiyyah. If the husband was not lying in his oath, then no divorce occurs, and his statement is to be taken into consideration. If he beats his wife without justification, she is permitted to seek divorce, but divorce should not be resorted to except after all means of reconciliation have become impossible.
