Whoever damages another's property must guarantee it and search for its owner or his heirs. If unable to find them, he should donate it as charity on their behalf, while still guaranteeing it should the owner be found. This is justified by the legal principle that the unknown is like the non-existent in Islamic law, and by the verse: "So fear Allah as much as you are able." As for a witness to a car accident, he must inform the car owner or the relevant authorities to protect people's property. If he neglects this duty and the owner's right is lost, then he is liable to guarantee it.
