For the marriage to be valid, the guardian must be a close relative, and there must be two just witnesses; otherwise, the marriage is void. If the contract is void and the young man and woman wish to enter into another contract, they must repent from fornication, with the presence of the guardian and two just witnesses. If the brother is the closest guardian to the girl, and he is assured of their repentance, and he witnesses the contract, then the first secret contract is valid and its effects are binding.
