However, if the endower does not specify, then poor Dhimmis (non-Muslims living under Muslim rule) may benefit from it, because giving charity to them is considered an act of devotion. It is a condition that the beneficiary of the endowment be a charitable and devotional cause, whether the beneficiary is a Muslim or a Dhimmi. Indeed, it is narrated that Safiyyah bint Huyayy endowed for her Jewish brother.
