If the creditor can acknowledge the truth and file the case in his own name, then it is not permissible for his brother to lie or swear an oath. However, if acknowledging the truth leads to the loss of money and there is no way to save it except through stratagem, then there is no harm for his brother in lying to save it, and there is no expiation for swearing an oath in such a case, according to the majority of scholars. Thus, any commendable objective that can be achieved without lying makes lying impermissible, but if it cannot be achieved except through lying, then it is permissible. Lying can take on the five legal rulings, including being obligatory to save a protected life or property from an oppressor.
