If a husband swears by divorce that he will not eat his wife's food, and then eats from it, his divorce takes effect according to the majority of scholars, whether he intended divorce or merely a threat. However, Sheikh al-Islam Ibn Taymiyyah holds that if he intended a threat and not the actual occurrence of divorce, then he must offer expiation for an oath (kaffarat yamin) and the divorce does not take place. The preponderant view is to consider the intention of the swearer; if he had no specific intention, then reference is made to the reason for the oath. Swearing by divorce is among the oaths of the dissolute and can lead to dire consequences. The lawful oath is by Allah Almighty.
