A husband's divorce of his wife, while he is conscious of what he is saying, is effective, even if he is angry, unless he loses consciousness. The divorce of a menstruating woman is effective, according to the preponderant opinion. If the husband says: "Divorced, and you will return to your family's home," and he intends it as a confirmation of the first divorce, then it is one divorce. But if he intends to initiate another divorce, then they are two divorces.
The husband has the right to take his wife back without a new contract as long as she is within her waiting period (). If the waiting period ends, he may not take her back except with a new contract.
The wife must repent from hitting her husband and verbally abusing him, and the husband must repent from hitting his wife. Mutual understanding and respect between the spouses are recommended.
