Do parents forfeit their right to custody if they abuse and beat their child, and to whom does custody transfer in this case?

The purpose of custody is to protect the child in custody, raise them, and look after their interests. There are two cases regarding parental abuse of a child in custody:

1. First Case: If the abuse is of the commonly recognized type for disciplining children, this does not forfeit the parents' right to custody, even if the wrongdodoer is admonished for their mistake. 2. Second Case: If the abuse is in the form of torture, this contradicts the purpose of custody, and the matter should be referred to the Sharia (definition) judge to take appropriate action.
