What is the ruling on a divorce oath sworn by uttering the triple divorce formula, conditioned on the wife's statement, "I will deal with your family according to my mood," after a dispute regarding her treatment of the husband's family?
If you swore by divorce thrice upon your wife that she should not treat your parents except as you see fit, then the prevailing is that she is divorced thrice if she violates that, and this is the opinion of most scholars. Some scholars, like Ibn Taymiyyah, hold that this oath is like an oath by Allah, so if the breach occurs, you are obligated to pay the expiation of an oath, and when intending divorce, he believes that divorce pronounced thrice counts as one. Because the issue involves detail and disagreement, we advise presenting it to trustworthy scholars. And know that the legitimate oath is by Allah, and swearing by divorce is from the oaths of the wicked, and it may result in consequences that are not commendable.
