Is divorce obligatory in this case, knowing that the foreign woman who recently converted to Islam has returned to practicing the rituals of her former religion? And must the husband return to his wife and her country and endure for the sake of the child, despite his fear of her defiance and his inability to raise the child Islamically in her country?

Merely uttering the two testimonies of faith (Shahadatayn) is not sufficient to enter Islam; one must also adhere to its outward rituals. Marriage to a chaste woman from the People of the Book is permissible. If the marriage fulfills the conditions, such as the presence of a guardian (wali) and witnesses, then the marriage is valid, and there is no obligation to divorce her. However, divorcing her might be preferable to obtain custody of the daughter in a Muslim country. An attempt should be made to bring the wife and daughter to reside in a Muslim country to raise the girl in the Islamic creed, and perhaps this will encourage the wife to embrace Islam. As for residing in lands of disbelief, it is permissible for those who can outwardly practice their religion, but residing in a Muslim country is preferable due to the dangers present in lands of disbelief. If any of the conditions for the validity of the marriage, such as the guardian, are not met, then it is void and must be annulled or dissolved.
