Swearing an oath of divorce to do or not do something is a conditional divorce according to the majority of scholars, and it takes effect when the condition is met. It cannot be dissolved, and this is the .
Some scholars are of the view that if the intention behind the divorce was to make it conditional, then it is a conditional divorce. However, if the intention was merely to swear an oath, then it can be dissolved with an expiation (kaffara).
If the reason for the oath was a quarrel and animosity, and this reason has ceased to exist, then the oath is dissolved according to some scholars, such as the Hanbalis and Malikis.
