Is the fallow land, or the land that has been under possession for a long time without cultivation, considered an inheritance when divided among the tribe members?

Land that is barren (mawat) and not owned by anyone becomes the property of whoever revives it through cultivation or irrigation. Therefore, marking off barren land (tahjir) does not confer ownership, but it does establish the individual's right to it. This right can be inherited. However, if the person who marked off the land leaves it uncultivated for three years, the ruler has the authority to reclaim it from him.
