Is the husband sinful for delaying the division of the pending inheritance, knowing that it is not in his hands, and he is able to pay the necessary money for the division, but he wants a guarantee for his money?

The legal principle is that a person is not sinful for what they are unable to do or what causes them unbearable hardship; this is based on Allah Almighty's saying: ﴿Allah does not burden a soul beyond its capacity﴾. The amounts required by the state to complete the division of inheritance or to receive and register it are borne by all heirs, each according to their share.
