Is a wife considered disobedient (nashiz) or an oppressor if she leaves her husband's home and goes to her parents' house after his insults escalated to include her family, and he prevented her from visiting them and insulted her father, in addition to forsaking her in bed, filing a lawsuit for obedience against her, and not spending on their children?

Issues of dispute are not resolved by a fatwa; rather, their recourse is to the judiciary for a ruling. The wife leaving the home without her husband's permission, when there is no harm to her in remaining there, is considered an act of defiance (nushooz), and she must return to her husband's home unless she has a valid excuse. The maintenance of young children who are in need of support is obligatory upon the father according to what is customary.
