The majority of scholars are of the opinion that swearing an oath by divorce results in divorce upon breaking the oath, and that uttering the triple divorce pronouncement counts as three divorces. Some scholars, like Ibn Taymiyyah, are of the view that swearing an oath by divorce, when the intention is not to make the divorce conditional but rather to threaten, is treated like an oath sworn by Allah, requiring an expiation for an oath (kaffarat yamin) if broken, and no divorce occurs. They also hold that uttering the triple divorce pronouncement counts as a single divorce. The fatwa, however, is that the triple divorce occurs upon breaking the oath, and the determination of whether the oath was broken depends on the intention of the one who swore the oath. It should be noted that the permissible oath is one sworn by Allah Almighty.
