Is it permissible, Islamically, to lease a piece of land for the purpose of extracting building stones, knowing that the lessee is aware of the presence of suitable stones within it?

It is not permissible to lease land for the purpose of extracting stones from it, because leasing applies to usufructs (benefits) and not to the principal objects themselves, and stones are a principal object. The permissible alternative, according to Sharia, is for the landowner to hire someone to extract a specific quantity of stones for a determined wage, and then sell these stones.
