The answer

It is permissible to use what is customarily used, and what is known that its owner does not dislike or find it difficult. Anything else is included in the prohibition of a Muslim's property except with his permission.

Ibn Hajar Al-Haytami permitted acting upon presumed consent, and explicitly stated that strong presumption is equivalent to certainty in this matter. So, whenever one strongly presumes that the owner permits taking something, it is permissible to take it. However, if it turns out contrary to his presumption, he is obligated to guarantee it.
