Is it permissible to hunt birds at night while they are asleep, and is it permissible to hunt them by throwing stones at them?

Hunting birds at night does not differ from the ruling on hunting them during the day. Hunting them for sport is disliked (makrooh), and it is forbidden to kill them without the intention of ritual slaughter (dhakāt). Hunting them for food is permissible. There is no harm in throwing stones at them with the intention of ritual slaughter, provided the name of Allah is mentioned (tasmiyah) and one hastens to slaughter them if possible. It is a condition that the stone be sharp. If it has a sharp edge and a broad side, it must be ensured that the bird is struck by the sharp edge and not the broad side. So, if one shoots with a sharp object like a sword and strikes it with its edge, it is permissible to eat. But if one shoots with something that has no edge, like a bullet, or strikes it with its broad side, it is not permissible; this is based on the hadith of Adi ibn Hatim concerning hunting with an arrow (mi'rāḍ): "If you strike it with its sharp edge, then eat; but if you strike it with its broad side, do not eat, for it is a beast beaten to death."
