Before accusing a wife of insubordination (nushooz), one should verify and understand the meaning of insubordination and its regulations, as it is a religious ruling that entails many other rulings. Insubordination waives the wife's right to maintenance, dwelling, and equitable division (of nights), but it does not waive her right to the dower (both prompt and deferred). If the wife is rightfully insubordinate, she is not entitled to maintenance for that period. It is not permissible for the husband to be both the plaintiff and the judge at the same time; rather, a religious judge or a trustworthy, upright individual should rule on insubordination. If the husband divorces her, he must pay her the full dower.
