What is the ruling of Islamic law regarding the community's opposition to my possession of a portion of communal land, with legal documents, for the purpose of utilizing it?

1 min readAlso available in العربية

It is permissible to sell a plot of land and utilize it for agriculture if it is demarcated and known. However, if it is not demarcated and is intermingled, it is permissible to sell it, but neither the buyer nor the original owner may utilize it without the permission of the other partners; otherwise, their action would be considered usurpation. If one of the partners wishes to cultivate the common land and the others refuse, then the land shall be divided and the shares of the partners shall be demarcated, and the partners have the right of pre-emption over their partner's share if he wishes to sell it.
