The answer

If a full year has passed on the money you invested with your partner, then becomes obligatory on you for it, and for any profit generated from it. The obligation of Zakat is not waived if the money is stolen or destroyed after the year has passed and you were able to pay it.

However, if you were unable to pay the Zakat, or if a full year had not passed on it, then there is no Zakat due on you for it. But if you recover your money thereafter, its ruling concerning Zakat is the same as that of usurped money: you are obligated to pay Zakat for the past years according to the Shafi'i and Hanbali schools. According to the Maliki school, Zakat is only obligatory once after its recovery.
