If the supervisor of an endowment (waqf) commits a transgression (fisq) and then returns to righteousness, his supervision is reinstated if his appointment was stipulated in the original endowment deed and explicitly named. However, if it was not stipulated in such a way, his supervision is not reinstated. Imam al-Nawawi issued a fatwa to this effect, and Ibn al-Rif’ah and others agreed with him, believing that there should be no disagreement on this issue due to its strength.
