Marriage without a guardian is invalid according to the more preponderant opinion. Khul' does not require a judge's ruling, according to the majority of jurists. Some scholars are of the opinion that separation in marriages whose validity is disputed, such as marriage without a guardian, does not require a judge's ruling. A Muslim must ask the people of knowledge about what he does not know before acting upon it.
