The fatwa we adhere to is that a conditional divorce takes effect upon the fulfillment of the condition, regardless of whether the husband intended divorce, emphasis, or threat. Some scholars hold the view that if swearing an oath of divorce and making it conditional is done without the intention of divorce, it does not take effect, and the one who swore the oath is required to offer an expiation for a broken oath (kaffarat yameen). If the husband acts according to one of these opinions, there is no blame on him, and some scholars permit changing one's adherence to a particular scholarly opinion (taqleed). If the spouses differ regarding a divorce, the husband's statement is primarily considered. If the wife is certain that her husband pronounced three divorces upon her, but he denies it, or if the husband follows a madhhab (school of thought) and the wife believes it to be invalid, then it is not permissible for her to remain with him, and she must separate from him.
