Is the husband's statement, "If you touch my phone without my permission, you will be divorced," and then his later renewal of that statement, and his saying, "If you make a third mistake, you will be divorced," considered a conditional divorce?

As long as your husband permitted you to take his phone and browse it, his oath is dissolved, and no divorce occurs, because permission dissolves an oath.

As for his statement: "If you make a third mistake, you will be divorced"; if it was a promise of divorce, it does not occur. But if it was a suspension of divorce upon your mistake and the mistake occurred, then divorce has taken place.

If divorce has taken place and it is not the third divorce, your husband may take you back before the expiry of your waiting period.
